National Stock Car Racing Appeals Panel Statement

 

DAYTONA BEACH, Fla. (Oct. 3, 2011) - On September 28, 2011, the National Stock Car Racing Appeals Panel heard and considered the appeal of the #11 Gaunt Brothers Racing NASCAR Canadian Tire Series team.

The penalties concern Section 12-1 of the NASCAR Rule Book “Actions detrimental to stock car racing. Section 12-4-I: “Any determination by NASCAR Officials that the Race Equipment used in the Event does not conform to NASCAR rules. Section 20E-5.10.A: Carburetor Eligibility: the carburetor must remain as supplied by the NASCAR-approved supplier: Unapproved carburetor modification; power valves.”

This stemmed from a post-race inspection for the NASCAR Canadian Tire Series at Circuit Gilles Villeneuve on August 20, 2011.

The original penalties assessed were:

·         Car Owner (Martin N. Gaunt): Loss of 100 NASCAR Canadian Tire Series Championship Car Owner Points;

Crew Chief (Jonathan W. Davis): $5,000 fine. Suspended from NASCAR until fine is paid. Placed on NASCAR probation for the next two (2) NASCAR Canadian Tire Series Events. Placed on NASCAR probation until September 21, 2011;
·         Car Driver (Jason S. Bowles): Loss of 100 NASCAR Canadian Tire Series Championship Driver Points.

The Appellant acknowledged the power valve change to a Holley factory block-off part was not allowed per the 2011 rulebook. The Appellant contested the severity and communication process related to the carburetor rule change for the 2011 racing season.

Upon hearing the testimony and carefully reviewing the facts, the unanimous decision of the National Stock Car Racing Appeals Panel was to modify the original penalties assessed by NASCAR. The Appeals Panel waived the $5,000 fine to the Crew Chief while all other aspects of the penalties stood as originally assessed. 

The Appellants have the right under Section 15 of the Rule Book to appeal this decision to the National Stock Car Racing Chief Appellate Officer.

It is a little bit of overkill when the fines are more then what it pays to win.
Nascar needs to take a look at what they are doing to kill there own series with bogus calls like this one. I think it would have made much more sence to take away points, keep the parts that are in question and let the guys continue racing instead of reaching into there pockets for extra cash for the off season party down south at the France Lodge.

One big reason is the travel expence of the CTS that covers coast to coast. Saturday night racers travel about 50 miles and can travel to a different track if caught cheating and usaully only suffer another 50 mile tour. The cost of travel in a series that is under funded for winnings like the CTS program should be taken into consideration.
When you have a series that is suffering car counts becasue of cost there needs to be a little bit of a break.....even if you are cheating.... and most of them are... but not getting caught !!
Good thing, but in most racing there is always one part on a car that could be in question by tech, and in most cases its a slap on the rist not a grab of $5,000.00.
I am not saying that cheating is good- but it happens all the time in any series.

Really Mid you want to bring up the discussion of a series and hurting car counts?  You have chose to work with a series that is trying to develop and that's great wish you the best of luck with that.  However if you follow the NCATS series that closely you would see that once again this year a number of teams tried their hand at the series for multiple races which allowed the car counts to remain over 20 cars plus for all events less Mosport Oval and Riverside where there were 19 cars racing.  If the teams in the series were having that hard of a time covering those costs would the cars keep travelling from east coast to west coast to compete in the series?  As the saying goes its their sandbox so you have to play by their rules so every team and its members accepted the risk when they signed up so it should be no surprise to any of them when they got caught breaking the rules.

DW...your point is well taken, but what I am saying is if the cost/overhead was lower and the payouts higher this series could grow to 40 cars- and that would be much better for everyone involved. These cars are not your typical Late Model Car, but instead a truly designed car out of the norm for this series- so getting finned or thrown out leaves you in a very tough spot with nowhere else to race this type of car.
I for one would love to see the CTS program take off as its good for Racers- Sponsors and Fans alike and making the series more affordable would help to make the soup so to speak.

I'd like to see that series run LM/ Template SLM type cars...but alas, we'll never see that day.

Burbiotch - there is already series out there that do run a Lm or Slm type cars and they travel across Ontario so there is no need to have another series with similar styles.

Mid- all I can say is that there have been more and more teams making multiple appearances in the series and hopefully in time those teams can continue to grow their program and eventually race full time in the series.  With the increased exposure of the series there are gradually more and more sponsors becoming involved in the series and it is helping both the series and the teams.  Is the level of sponsorship in the series where it deserves of course not but as many of the Sprint Cup teams are discovering the days of 1 full time sponsor are long gone and they are now having multi sponsor programs going. In my opinion I think to help grow both NCATS and OSS series they need to consider running a joint racing weekend.  But will it ever happen?? Who knows.  In regards to payouts the average fan has no idea whether they are winning more.  It appears that they are getting greater payouts otherwise the teams that are trying to make it in the series wouldn't keep trying to make a go of it in the series.  As for the overhead that depends on how much more change the series is gonna make in regards to parts for the cars.  If drastic changes are made then you are right overhead won't go down.  If nothing major changes then the overhead might just maintain itself.
